Fodo Terms of Service
Draft pending legal review. Highlighted fields will be completed before the app is published.
Version: DRAFT · Effective date: DATA_WEJSCIA_W_ZYCIE
1. Who we are and what these terms cover
- The Fodo mobile application ("Fodo", "the app") is provided by: Logi Labs sp. z o.o., a company registered in Warsaw, Poland (KRS 0001226746, NIP 7011302004) ul. Rokosowska 11/15, Warsaw ("the Operator", "we").
- These terms govern the use of Fodo, including its free and paid features, available through the App Store (iOS) and Google Play (Android).
- By installing the app and creating an account you enter into an agreement with us for the provision of an electronic service on these terms.
- Contact: [email protected].
2. What Fodo is — and what it is not
- Fodo is an educational and organisational tool: it guides you step by step through the low FODMAP diet protocol (elimination → reintroduction → tolerance profile), provides an ingredient database with FODMAP ratings, a symptom and meal diary, an AI meal scanner, and a PDF report for working with a dietitian.
- Fodo is not a medical device, does not diagnose, does not treat, and does not replace a doctor or a dietitian. Information in the app, including FODMAP ratings and test verdicts, is educational in nature.
- The low FODMAP diet is intended for people with IBS — ideally after a diagnosis made by a doctor. We recommend going through the protocol in collaboration with a dietitian or doctor; the app facilitates that collaboration (the PDF report) — it does not replace it. If your symptoms worsen, change in character, or something new and worrying appears — contact a doctor, not the app.
- Safety exclusions: the elimination protocol is not available in the app to people who are pregnant, under 18 years of age, or underweight — in those cases the ingredient database and educational materials remain available. Your answers in the onboarding safety screening must be truthful — your safety depends on them.
- The verdict of a single food test is a hint, not a diagnosis.
3. Account and requirements
- Age: Fodo may be used by people aged 16 or over. The elimination protocol is available only to adults (§2(4)).
- Anonymous account: an account is created automatically at first launch and is bound to your device. It requires no personal data.
- Email linking (optional, recommended): you may link your account to an email address (one-time OTP code) or to an Apple/Google account. Without linking, losing or changing your device may mean irreversible loss of the data and purchased entitlements tied to the anonymous account — the app warns you about this.
- Your account is personal; do not share your sign-in credentials with third parties.
- Account deletion: you may delete your account at any time in the app (Settings → Account → Delete account). Deletion is irreversible and involves a full data purge (details in the Privacy Policy). Before deleting you can export your data (a JSON file).
4. Free tier and limits
- Available free of charge and indefinitely are, in particular: the ingredient database with FODMAP ratings (unlimited lookup), educational materials, the starting questionnaire, and basic symptom diary logging.
- The AI scanner has a daily scan limit depending on your plan (at launch: 3 scans per day on the free plan). The limit resets according to your local day. Current limits are always visible in the app.
- Limits and safeguards (including device integrity verification — App Attest / Play Integrity) protect the service against abuse. Circumventing limits, automating requests, or mass-creating anonymous accounts is prohibited (§8).
5. Paid products
- We offer two independent products:
- Protocol — a one-time purchase (lifetime, non-consumable): the full guided three-phase plan, tolerance profile, PDF report, daily stacking analysis, your profile overlaid on the ingredient database, and the ability to reset the protocol (the archive of past runs is kept). While a protocol is active, the scanner limit is 15 scans per day (for at most 180 days of active protocol), after which it returns to the free limit.
- Fodo+ — an annual, auto-renewing subscription (an add-on): the meal nutrition layer, extended reports (Reports+), 30 scans per day (beyond that — a reduced model tier instead of refusal), and future modules for the duration of the subscription. Fodo+ does not include the Protocol — they are separate purchases.
- No purchase includes an unlimited AI scanner. Scan limits apply on every plan and are described on the purchase screen.
- Prices and payment: prices are displayed in the app before purchase, in your store's currency. Payment, including card details, is handled solely by Apple (App Store) or Google (Google Play) under those platforms' terms — we have no access to your payment details.
- The Fodo+ subscription renews automatically for another year unless you turn off renewal in your App Store / Google Play subscription settings at least 24 hours before the end of the current period. You manage the subscription (including cancellation) in the platform's settings, not in the app.
- Withdrawal and refunds: refunds for App Store and Google Play purchases are governed by those platforms' rules and handled by Apple/Google. As regards the right of withdrawal from a contract for the supply of digital content, consumer law and the procedures of the platform through which the purchase was made apply. A refund revokes exactly the purchase it concerns.
- Restoring purchases: you can restore purchases on a new device using "Restore purchases" (same store account; to keep your data — a linked Fodo account, §3(3)).
- Plan parameters (including scan limits) may be adjusted over time — changes to the detriment of paying users are made only through the terms-amendment procedure (§11), respecting the essence of the purchase: deterministic features covered by a lifetime purchase remain available indefinitely.
6. AI scanner
- The scanner recognises meal ingredients from a photo or description using AI models. The result is a suggestion — it may be incomplete or wrong; you can edit it and you decide whether to save the meal. Ingredients without a confident FODMAP rating are flagged cautiously.
- Submit photos of food only. Do not submit unlawful content, images of people, or other people's data.
- The rules for photo processing (EXIF stripping, no storage after recognition) are described in the Privacy Policy.
- A scan that fails for technical reasons or with a typed recognition error does not consume your daily limit.
7. Service availability
- The core of the app (plan, diary, cached database) works offline; the AI scanner and synchronisation require an internet connection.
- We strive to keep the service running without interruption, but technical breaks are possible (maintenance, outages, updates). We announce planned significant interruptions in the app.
- We may require updating the app to a minimum version where necessary for the security or integrity of the service.
8. Acceptable use (prohibited conduct)
The following are prohibited in particular: (a) circumventing limits, safeguards, or payment mechanisms; (b) reverse engineering, scraping, or bulk downloading of the ingredient database; (c) automating requests to the service beyond normal app usage; (d) creating multiple accounts to bypass limits; (e) submitting unlawful content; (f) reselling the service or providing it to third parties as your own. Violations may result in feature restrictions or — after an unheeded warning, and in flagrant cases immediately — account suspension. You have the right to lodge a complaint (§10).
9. Intellectual property and licence
- The app, its content (including the ingredient database with FODMAP ratings, educational materials, and graphics), and the Fodo marks are protected by law. You receive a non-exclusive, non-transferable licence to use the app for your own non-commercial use, on devices linked to your store account.
- Your data (diary, entries, photos) remains yours. You grant us only the technical licence necessary to provide the service (hosting, synchronisation, scan processing) — to the extent described in the Privacy Policy.
- The PDF report is intended for your own use and for consultation with your specialist.
10. Liability and complaints
- We provide the service with due care. Nothing in these terms excludes or limits consumer rights arising from mandatory provisions of law, including liability for the conformity of digital content and digital services with the contract.
- We are not liable for the consequences of health and dietary decisions made contrary to §2 (educational nature, recommendation of specialist care, safety exclusions), nor for untruthful answers in the safety screening.
- Complaints about the operation of the app may be submitted to [email protected]. We respond within 14 days. Complaints about payments and refunds are handled by the purchase platform (Apple/Google) under its own rules; we will help you find the right path.
- Consumers may use out-of-court complaint and redress mechanisms, including the European Commission's ODR platform (ec.europa.eu/consumers/odr) and consumer ombudsmen.
11. Changes to the terms and discontinuation of the service
- We may amend these terms for valid reasons (changes in law, service features, security considerations, platform-side changes). We will announce changes in the app at least 14 days in advance; changes do not apply retroactively. If you do not accept the changes, you may stop using the service and delete your account; where consumer law so provides, you have further rights.
- You may terminate the agreement at any time by deleting your account (§3(5)).
- If we decide to discontinue the service, we will give reasonable advance notice and enable data export; consumer rights concerning purchases remain unaffected.
12. Governing law
- These terms are governed by Polish law. This choice of law does not deprive consumers of the protection afforded by provisions of the law of their country of habitual residence that cannot be derogated from by agreement.
- Consumer disputes are resolved by the court having jurisdiction under general rules.
13. Final provisions
- The Privacy Policy and the consents given in the app (health data consent, analytics consent — separate from acceptance of these terms) form an integral part of the agreement.
- Apple and Google are not parties to this agreement; you are also bound by the terms of the platform (App Store / Google Play) you use.
- If any individual provision proves invalid, the remaining provisions stay in force.
